IJM Cebu Secures First Anti- Trafficking Conviction

CEBU, THE PHILIPPINES – On Tuesday, August 10, IJM Cebu received its first anti-trafficking conviction – only the fourth such conviction ever to be handed down in the entire region. The case began in May 2008 when IJM assisted the Cebu City Police Office conduct a sting operation, which led to the arrest of a pimp who had been trafficking minors for sex. The operation also resulted in the rescue of 17-year-old Charlyn* and an adult trafficking victim.

After a two year legal battle, in which Charlyn herself bravely testified in court and pointed out the pimp who had sold her, justice was served as the perpetrator was sentenced to 20 years in prison.

Since becoming operational in Cebu in 2006, IJM Cebu has found that it can take judges anywhere from two to four years to reach a decision in an anti-trafficking case – because there are not enough courts for the number of cases being tried, hearings are only scheduled approximately every three months, prolonging the legal process for years. Though IJM Cebu has dozens of cases pending, this is the first to come to a conviction – the first, the team hopes, of many.

Charlyn, the survivor rescued in the case, now lives in the care of a loving aftercare home, where she has chosen to volunteer with vulnerable street children. Her IJM social workers continue to provide ongoing support.

Upon the announcement of the conviction, Giovanni Luna, the IJM attorney who prosecuted this case alongside the public prosecutor, celebrated: “This victory in court allows me to realize that justice is real here on earth, as it is beyond.”

Miss BC uses her title to speak out about human trafficking

Miss BC: Modern-day Abolitionist

"I am simply an ordinary person who has stepped into the role of abolitionist, and chosen to use my voice to advocate for people who have been oppressed, exploited and enslaved around the world." Well, maybe not so ordinary. Those are the words of Tara Teng, otherwise known as the reigning Miss British Columbia.

Crowned in July of 2010, Tara is an example of a fresh new wave of Canadian youth activism, committed to ridding the world of modern-day slavery and human trafficking. She firmly believes it is possible and has chosen IJM Canada as one of the avenues to accomplish her goal.

"I want to be a voice for justice, love and mercy worldwide," says Tara, 21. "I want to partner with the work that IJM is doing and help promote their work because I truly respect the things they do and the heart that they have for justice and God's glory."

IJM has a special appeal for Tara because of the comprehensive approach taken to the issues surrounding human trafficking and slavery. "It is not just awareness and rescue-based, but followed up with the appropriate legal action to make sure that criminals are held accountable for their crimes," says Tara. "Although I am born and raised in Canada, my family is of South Asian heritage. This knowledge always makes me wonder what my life would be like if I was born somewhere else."

Tara hopes to use the public interest and media attention — the natural platform — of being Miss BC to share her passion. "I want the general public to know the reality of oppression that slaves live with each day. I want to see compassion become our passion," explains Tara. "Each speaking engagement is an opportunity to spread awareness, share the stories of the slaves and advocate for freedom and justice. I want to encourage others to become world changers and history makers as we fight to see the re-abolition of slavery in our world."

Conviction Secured in Luisa's Case after Violent Assault

GUATEMALA CITY - After three years, two trials, and a lengthy investigation, victory was secured as Luisa´s* perpetrator was convicted of rape and sentenced to eight years in prison this June. “Now I can live my life in peace,” said 16-year-old Luisa at the news of the conviction, smiling widely and with deep relief evident in her eyes.

At the age of 13, Luisa was walking in her neighborhood when an older man approached her and said he had something to give to her mother. Luisa followed the man to his pick-up truck to retrieve the item, but instead the man shoved her into his truck, tied her with rope and violently raped her. He threatened to kill her family if she told anyone what he had done. Terrified, Luisa kept silent. But she could keep the abuse a secret no longer when her mother took her to the doctors, where it was determined that Luisa was pregnant.

Luisa’s family filed a report with the Public Ministry. The family was referred to International Justice Mission in 2008, when Luisa was six months pregnant.

IJM’s legal team fought a hard battle in the courts that culminated in a trial in December 2008 – and was saddened and surprised when that trial resulted in the soft conviction of statutory rape, indicating that 13-year-old Luisa had consented to relations with the 60-year-old accused perpetrator. He was set free and was only required to complete a short sentence which could be carried out from his home.

Believing the judgment to be unjust – knowing that the judges in the case had even made light of the rape during the trial – the IJM Guatemala legal team knew they could not stop fighting for Luisa and applied for an appeal.

While waiting on the appeal, Luisa continued to heal. With a precious baby boy now in her care, she continued with school and attended IJM Guatemala’s young mothers’ support group. Through the young mothers’ group, she learned to make jewelry, which she now creates and sells to earn income for her and her son.

International Justice Mission´s attorneys prevailed on appeal and won a new trial. Although all the same evidence and testimonies were used again, Luisa was blessed to receive different judges who cared to listen to her case and search for the truth. Although three years had passed, Luisa was brave as she took the witness stand for the second time and recounted her trauma.

Luisa’s plea did not go unheard, and persistence paid off as her perpetrator was convicted of rape and sentenced to 8 years in prison.

The IJM Guatemala team has been encouraged by Luisa’s positive, bright spirit throughout this difficult process – she has recently helped to lead the young mothers’ group, serving as an example for other girls who have known similar pain. She has also begun taking English classes on the weekends, and her dream is to be accepted into a University in the United States.

Rice Mill Rescue Operation Frees 22 Forced Labourers

CHENNAI, INDIA – Late this September, Indian government officials partnered with International Justice Mission Chennai to conduct an operation at a MBS Kalam, a rice mill on the outskirts of Chennai – an action which resulted in the rescue of 22 forced labour slaves and their children from brutal conditions.

As the rescue team approached the facility, the labourers gestured excitedly for them to enter. It quickly became apparent that the owners of MBS Kalam were not only exploiting adults as forced labourers in the mill, but had also enlisted the labourers’ children; six-year-old Manjula, barefoot on the searing concrete floor, ceased sweeping and left a trail of tiny footprints in the rice as she sprinted to meet her rescuers.

Government officials and IJM staff helped the victims pack their scant belongings and escorted them to the local government office for an in-depth inquiry. There, Chenchamma, a 55-year-old victim, broke into tears as she recounted her blind husband’s last request: “If I die, please come to bury me, so I am not alone.” When he passed away in his native village earlier this year, Chenchamma requested permission to fulfill her promise. The owner responded, “The people in the village will dispose of the body. You cannot go since you have work in the mill.”

Moved by the labourers’ suffering, and convinced that this was a clear case of forced labour, the lead government officer on the operation issued each of the victims a Release Certificate, an official government document that legally releases the victims from their supposed debts, and guarantees them access to government assistance as they rebuild their lives. Each released labourer was also given 1000 rupees (roughly equivalent to $20) as mandated by India’s Bonded Labour Act, in order to meet their basic needs as they begin the rehabilitation process. These funds will be supplemented by the Indian government to further assist them as they settle in their villages.

IJM Aftercare Manager Abishek Joseph highlighted the importance of these funds: “The initial rehab money will be a great help for these labourers as they begin to rebuild their lives. Most of them do not have proper housing and with the initial money they will build a small hut and live with freedom.” IJM social workers will continue to support the freed men, women and children as they create new lives in their home village.

Perpetrator In Guatemala Sexual Violence Case Sentenced

GUATEMALA CITY – One by one, they took the stand, speaking slowly but confidently, sometimes blinking back tears. In a small Guatemala City courtroom this September, five children courageously broke the silence, sharing the difficult, terrible truth: Their father had systematically and brutally abused them, both through violent physical abuse and, in his daughters’ cases, sexual assault.

Now 17 years old, Astrid Rosa’s* abuse began when she was 7 years old, increasing in frequency and brutality as she grew older. She eventually discovered that three of her sisters had been enduring the same nightmare. Living in a poverty-stricken home with seven other siblings, her mother, and her abusive father, Astrid Rosa eventually found hope in an unlikely place: the city dump.

Astrid Rosa and her siblings were forced by their father to work every day at the dump to collect recyclable materials for resale. When the staff of a local children’s organization saw the siblings working there, they noticed evidence of physical abuse and suspected sexual abuse as well. They reported the case to IJM Guatemala.

In October 2009, IJM social worker Miriam Cruz met seven of the siblings at the offices of Guatemala’s Public Ministry to help them file a report – the very difficult first step in their journey to justice. But Miriam quickly noticed that their mother was not with them at the offices. She was afraid to come, the children explained, because their father had previously threatened their lives if they told anyone about the abuse. Miriam encouraged them to contact her, knowing how important her presence would be to the children. Hearing their plea, their mother agreed, and came to the government offices – ready, with her children, to break the silence about the abuse they were facing, despite the risk to their safety.

At the government offices, Astrid Rosa’s sentiment was simple: “I just want justice to be done for my family,” she told IJM staff.

That very night, the children and their mother filed the report together – on the condition that they wouldn’t have to return to their home for fear their father would kill them. At 10:00 p.m. that night, a judge allowed the children and their mother to enter a shelter, where they would be safe from harm.

With the children and their mother out of immediate danger, IJM’s investigator secured an arrest warrant and tracked down the aggressor. In December, in collaboration with IJM, the National Police arrested the father outside of his home.

IJM attorneys began preparing for what everyone knew would be a difficult case. As the children and their mother took turns on the witness stand this fall, they recounted their stories as they had in the Public Ministry Offices – but this time empowered, valiant and hopeful. IJM attorney Rudy Fuentes and social worker Miriam Cruz were with the family all throughout the process, comforting and encouraging them.

At the end of the trial, the judge sentenced the perpetrator to 95 years in prison for crimes against six individuals – including rape, sexual abuse, physical abuse and domestic violence. This is the second-longest prison sentence resulting from an IJM Guatemala case – exceeded only by a 2005 conviction of 106 years.

In the shelter, the siblings have been receiving excellent care and have learned new skills such as jewelry-making, cooking and other technical skills to help in their daily lives. They are attending school, and now that they are no longer in danger, they will soon be returning home, and will use their newfound skills to help secure a sustainable income for the family instead of working at the dump. The girls have also developed dreams for their future: Astrid Rosa’s 15-year-old sister Magda Gabriela* has decided that she would like to be a flight attendant or a bilingual secretary. While waiting outside the courtroom to testify, she was found practicing English with an IJM social work fellow.

The justice process has not only brought about a new sense of identity psychologically for these children, but literally as well. Two of Astrid Rosa’s sisters had never been documented at birth, and therefore did not have a birth certificate or an exact date of birth – leaving them unable to earn credits at school toward their eventual graduation. In addition to the 95 year sentence the judge issued, he also demanded that these girls be given birth certificates for the first time in their lives. Not only is the nightmare of their abuse at home over, but they have seen their great value affirmed: It has been declared in public that the abuse they faced was wrong, and they are now recognized as citizens of their own country. No longer are they treated like the refuse amongst which they were once forced to live – instead, they can now boldly believe that they have a hope and a future.

Last spring, four young women banded together in a fundraising challenge that resulted in a financial contribution to IJM Canada exceeding $37,000.

When Rachel Fagan, 14 of Langley, B.C. read about the M.A.D. (Making A Difference) Challenge in an IJM Canada newsletter, she knew it was something she wanted to do, even though she never dreamt that she and her team would win.

The unique fundraiser, initiated by Trinity Baptist Church in Sherwood Park, Alta, challenged Canadian youth from coast to coast to form small groups and see which group could raise the most funds in the most creative way possible to benefit the work and mission of IJM.

Rachel put together a team with her friends Talitha, Kendra and Kaitlin and the brainstorming began. Karen Fagan, Rachel's mother, acted as the required adult mentor for the group. "They had a lot of ideas, and there were a lot they didn't even get to. My role was to give them a lot of encouragement to not worry if they couldn't do all the ideas they had."

The idea they ran with — and won with — was a benefit concert headlined by B.C.'s own Carolyn Arends, a popular Christian singer. Fountains of melted fair-trade chocolate with fruit rounded out the June event, which drew over 230 people seated around 30 tables listening to music and hearing about the work of IJM.

Rachel, who spoke during the benefit concert, was proud and excited that their all girl team won. "I think we were able to raise so much partly because you could see that we all really believed in the idea and we were passionate about it, and passionate about getting others involved. We had displays on the tables; on one we had a rock and a hammer and a paper telling about people working in a rock quarry, and at another we had a piece of chocolate and a paper that told people about fair trade chocolate," explained Rachel. "It was really fun, it was just fun to get to organize a concert and get everybody there. A lot of people say that you're too young to do anything to help or raise money. And then, we were able to actually do this. It was really good." The girls raised $37,755 for IJM Canada, securing their first place in the M.A.D. Challenge and a speaking spot at IJM Canada’s upcoming benefit event in their area.

A few months later, the girls shared about their efforts at IJM Canada’s annual November benefit event in Vancouver, BC. At the event, the group was also presented with the SEEK JUSTICE Award. The SEEK JUSTICE Award is awarded to individuals who have partnered with IJM in a significant way to raise awareness about the issues of human trafficking, slavery and other forms of violent oppression, share how IJM is confronting these issues around the world and assist IJM in providing resources to carry out its work. An award of which each of the girls was fully deserving.

The M.A.D. Challenge consisted of 12 teams of youth between the ages of 12 and 18, for a total of 62 students. Over the course of 8 weeks, the teams raised a combined total $57,882.72, of which 100% of the proceeds were donated to IJM’s project fighting child sexual exploitation in Bolivia.

MUMBAI, INDIA – For much of her life, Rati* has fought to fend for herself. Her mother died when she was four. Her father, a bangle seller, later married a woman who refused to allow Rati to attend school, forcing her to stay home and do housework. When she complained to her father, he cruelly dismissed her - "You are not my daughter."

In late August 2010, Rati’s father and stepmother took her with them on a trip to Mumbai to meet a friend of her father. At the train station, her parents gave her a strange instruction: They told her to wait in a certain spot and then left. Rati waited all day at the station – growing more and more confused – and, by evening, she was very hungry. A woman at the train station approached her and offered some candy; ravenous, Rati ate it quickly.

But the woman was not a kind stranger. The candy was drugged, and Rati fell unconscious. When she awoke, she was in an unfamiliar place – a place she soon discovered was a brothel.

Padma, the brothel keeper, ordered her to take a bath and change into revealing clothing. When Rati refused, Padma beat her. She then tied Rati’s hands and legs together with a rope, and sent in her first customer, an old man.

In the next 15 days, Rati was raped two to three times every day. She persistently refused to serve customers; Padma responded to each refusal with a beating. Padma told Rati she would be forced to work in the brothel for two years, to pay back the sum for which she had bought Rati from the trafficker.

As Rati endured this nightmare, IJM staff had discovered Padma’s crimes – and began working with local authorities to plan a rescue operation.

On September 13, 2010, Rati and an older girl who worked at the brothel were watching TV in the brothel’s front room. Around 7 p.m., they overhead a woman from a neighboring brothel say she had seen police outside. Rati and the other girl were scared: Seeking to ensure they wouldn’t turn to the police for help, Padma had told them that the police would beat them if they were found. The girls had believed this, and both hurried up a ladder to the second-floor loft to hide as they had been instructed.

The rescue operation underway, IJM and police entered the brothel and searched the building for more than two hours, combing through four rooms on the main floor, two rooms in the second-floor loft, the brothel keeper’s quarters and the main foyer – but they could not find the two girls they knew to be held there. They searched three other neighboring brothels, with no results.

Growing desperate, at about 9:30 p.m., they noticed inconsistencies in the layout of the two floors of Padma’s brothel. Her quarters on the main floor extended a few feet further than the rooms directly above it in the loft. The team suspected a hidden compartment upstairs, but the wood mica wall paneling revealed no trapdoors or possible entrances.

Finally, the faint ringing sound of a cell phone indicated to the search team that someone was hiding beyond the wall.

Determined, police and IJM rescuers found a crowbar and broke through the back wall of the loft. Behind the wall were two teenage girls, shivering in the dark – one of them clutching the cell phone whose ring had betrayed their location. The compartment behind the wall was cramped and dirty, its small trap door hidden under the bed. The girls had hidden there, hands over their mouths to keep from making noise, for more than two hours.

The girls climbed out of the hole in the wall, shaking and crying. Rati immediately trusted the people she assumed to be her rescuers, pleading with IJM social workers to take her away. “This woman beats me, and forces me to serve customers,” she said. Padma was placed under arrest.

Leaving the brothel with police and IJM social workers, Rati calmed down. “I was waiting that someone should come,” she told a social worker.

“We told her not to worry,” said Sheela Alfanso, an IJM social worker. “‘We said, ‘no one is going to harm you. We are there for you. You have told someone to come and rescue you, so we came.”

While the second young woman rescued – a major – chose not to accept IJM’s offer of help, Rati is now recovering in an aftercare home, where she will learn basic literacy skills, Hindi, English and math. “I will stand on my own feet,” she said. “I will show my parents that even if they have left me at the train station, I have made something of my life.”

Justice for IJM Cambodia Clients

PHNOM PENH – “When you think about victims receiving justice in the courts… most people think of the ultimate sentence, which is part of what justice looks like. But it’s more than that.” IJM Cambodia Field Office Director Patrick Stayton says that seeking justice for Cambodia’s sex trafficking victims involves not only ensuring that perpetrators are sentenced to jail time for their crimes, but that their victims are awarded compensation.

In one recent court ruling, IJM Cambodia’s legal team saw both the fruit of their advocacy – and the need for continued resolve.

This fall, a Cambodian court sentenced three perpetrators to 10 years in prison following a trial in which three IJM clients testified against their traffickers.

Following the 2009 police operation that freed six victims from a brothel in Siem Reap, Cambodia, IJM staff helped place the victims in aftercare. They also provided legal assistance to the three victims who accepted IJM’s offer of free legal representation.

Despite clear evidence of a felony trafficking crime, the perpetrators were originally charged with a misdemeanor, facing just two to five years in prison if they were convicted. IJM lawyers challenged the charges. “We want our lawyers to skilfully advocate for the perpetrators to be charged according to facts of the case,” Stayton says. “We want to pursue justice in a full and fair way for each victim.” IJM’s advocacy for accurate charges was successful, and the case was tried under the correct article this fall.

At the end of the trial, a teenage victim testified that at the brothel she was regularly locked in a room for hours at a time and exploited by customers.

The brothel owner was convicted under Article 28 of Cambodia’s anti-trafficking law, declared guilty of procuring child prostitution. Two other perpetrators were convicted in absentia of being accomplices to the crime.

While the judges did sentence the three perpetrators to prison, they did not award much-needed financial compensation to the victims. IJM’s legal team is considering what strategies they may use to advocate for the victims’ financial restitution in the future. “There’s no amount of money that would adequately compensate for the kind of abuse the victims suffer,” Stayton says, but “it’s significant for the courts to order the compensation because it hits the perpetrators at the source of their motive for exploiting.”

IJM staff are encouraged that the courts responded to requests for a fair trial. As the clients continue to heal and gain dignity in their new lives, IJM staff will ensure they receive appropriate aftercare, and IJM’s legal team remains dedicated to advocating for the girls for as long as needed.

Trafficker Given Life Sentence

CEBU, THE PHILIPPINES - In February 2007, IJM took on its very first case in Cebu, the Philippines. Five women had been given an enticing job offer by one of their neighbours, who had promised them each work as singers in a band in Miri, Malaysia. Eager to earn money for their families, the women quit their jobs and spent a month taking singing lessons for the promised job. In November 2006, the women flew to Malaysia – only to find that the band did not exist and they had been trafficked to two Malaysian bars for sexual exploitation.

Incredibly, the women were able to escape the establishments, despite threats from the manager and lack of assistance from local officials. They were repatriated through the assistance of the Philippine Embassy and Cebu City Government, and when they had returned home, IJM began assisting them as they pressed charges against their traffickers.
Finally, nearly four years later, these women have been able to see justice done in their case. On Friday, October 29, the women appeared in court as the accused perpetrator was declared guilty on two counts of trafficking, one carrying a 20-year sentence, the reached verdict since IJM Cebu began operations in 2007 – both convictions.

The mood in the courtroom was heavy during sentencing, as the guilty trafficker was herself a young woman. The weight of that “guilty” pronouncement served as a reminder that the goal of seeking the prosecution of traffickers is not to avenge the exploitation of the victims – but to create a warning for other would-be criminals that engaging in modern-day slavery carries serious risks and grave consequences. “I hope this will send a message that there is a law and that it really works now,” says Stella Pueblos, Aftercare Manager for IJM Cebu and the social worker assisting the former victims in this case.

Judge Soliver Peras, the judge for the case, did not allow the courtroom audience to sit long in somber silence after the delivery of the sentences.

Instead, he delivered an exhortation: “Well, there are thousands still out there waiting to be rescued, so let’s go.”

<![endif]-->INTERNATIONAL ANTI-SLAVERY LEADERS CALL ON CANADIANS TO END MODERN-DAY SLAVERY

IJM Canada's Jamie McIntosh, Free the Slaves' Kevin Bales to speak at the launch of The Alliance Against Modern Slavery

For Immediate Release: January 28, 2010

LONDON, ONTARIO – IJM Canada executive director Jamie McIntosh and other national and international anti-trafficking leaders are calling on Canadians to take up their role in the battle for justice. Says McIntosh: “Canadians once fought slavery through the “underground railroad” and won; now is our time as a nation to lay fresh tracks to freedom.”

The urgency of this call was underscored yesterday at the World Economic Forum in Davos, Switzerland, as Richard Danzinger of the International Organization for Migration (IOM), affirmed that human trafficking is among the leading sources of profit for criminal activity today. In fact, this illicit trade generates approximately 32Billon USD in annual revenues. Indeed, in recent years there has been a mounting, credible body of evidence that tens of millions of people worldwide are held illegally enslaved for sex or labour. And yet despite occasional flashes of attention, the issue of modern slavery has languished at the sidelines of the global agenda.

In view of these disturbing realities, International Justice Mission (IJM) Canada urgently calls for the prioritization of global and Canadian efforts to combat human trafficking, and today embraces a key development in the announcement of a strategic alliance committed to slavery’s eradication.

“Concerted and sustained effort is required to counter the near-ominous grip of today’s slavers, who violently control the lives and extort the labour of countless individuals and families” says IJM Canada’s executive director, Jamie McIntosh.

Canadians are getting engaged in this fight. On January 28 – 29, 2011, newly-established Canadian NGO The Alliance Against Modern Slavery will celebrate its official launch with a Freedom Concert and conference. The events will bring international experts, government officials, law enforcement personnel, survivors of slavery and more to York University. The Alliance Against Modern Slavery (AAMS) will seek to engage Canadians in today’s abolition movement, pursuing a future in which “every person has the opportunity for sustainable freedom.”

Among notable experts such as Kevin Bales, President of Free the Slaves and a leading authority on modern slavery, and Marty van Doren, RCMP Human Trafficking Awareness Coordinator for Ontario, Jamie McIntosh will intersperse firsthand accounts of IJM’s anti-trafficking work in brick kilns and brothels in Asia, with insights from his academic research into historic human rights movements.

Still, McIntosh urges that any academic reflection lead to action on this burning human rights issue: “We’re drawn to this conference to ensure that slavery becomes history once again”.

“The shackles of modern slavery exert their hold on more victims now than at any other moment in history. Yet through the skilful application of modern investigative techniques, alongside the vigilant enforcement of national laws against slavery in all its forms,” McIntosh says, “IJM has seen the chains begin to fall.” In the past year alone, International Justice Mission has partnered with local authorities to rescue more than 800 victims of forced labour slavery and sex trafficking.

“With millions of lives hanging in the balance, it is imperative that we speedily scale proven initiatives to reverse the resurgence of slavery. We must act together to end this onslaught against our common humanity. Canadians once fought slavery through the “underground railroad” and won; now is our time as a nation to lay fresh tracks to freedom.”

For more information on the AAMS, or to schedule an interview, contact Karlee Sapoznik at (416) 736-2100 x. 44544 or karlee@allianceagainstmodernslavery.org or visit the website at http://www.allianceagainstmodernslavery.org/

For more information about the work of IJM Canada, or to arrange an interview with Jamie McIntosh, please contact IJM Canada at (519) 679-5030 x. 229 or by email at pbosma@ijm.ca.
52 Freed in India

The close of last week brought freedom to dozens of forced labor slaves as a result of operations conducted by IJM Field Offices in Bangalore and Chennai, India. On January 20, IJM Bangalore supported a rescue operation at a brick kiln - 36 forced laborers were freed and issued official government release certificates, which will entitle them to critical services and initial financial support to rebuild their lives. IJM social workers brought the released laborers back to their villages, where they will now live as free citizens.

The very next day, 16 more slaves were brought to freedom: 13 adults and 3 children left a rice mill in Chennai with release certificates in hand as the result of an IJM-supported operation at the facility. Owners of the rice mill were arrested onsite; IJM is providing ongoing aftercare support to the rescued families. Exhausted but overjoyed, one freed man shared his tearful response at the opportunity of life beyond the grueling 20-hour work day he had known, explaining, “I wasn’t even allowed to see my father while I was in the rice mill. Now I can see my father.”

Citizenship Secures a Future

CHIANG MAI, THAILAND – As Aasek and Buya prepared for the joyous experience of welcoming their first child into the world, the loving parents did everything possible to care for their new daughter, Warisara. The young couple travelled from their village to the closest hospital for their baby’s delivery. Then, after Warisara was born, Aasek and Buya followed the law and took their daughter to the district government office in order to obtain her birth certificate.

But as the young family waited in the district office to receive Warisara’s birth certificate, trouble arose. As district officials reviewed the parents’ identification, the officials discovered that Buya’s papers were incomplete. As a result, the officials told Warisara’s parents that they would not be able to issue the child a birth certificate – and without a birth certificate, she would not be considered a Thai citizen.

Aasek and Buya were well aware of Buya’s identification problem. Years earlier, Buya – a member of Thailand’s hill tribes – had applied for citizenship at her hometown district office. Although she had the legal right to Thai citizenship, she had never received the important documentation required to officially obtain this status. Not knowing how to resolve her legal situation, Buya resigned herself to a life without citizenship – a life in which she was ineligible for many jobs and government services, and not even allowed to move freely around the country.

An IJM partner organization discovered Warisara’s case and shared their situation with IJM. After reviewing the family’s papers, IJM staff met with Aasek and Buya to discuss how IJM could help their family.

“It was a serious problem,” said La-aw Kukaewkasem, the IJM legal status program assistant in Thailand. La-aw noted that lacking a birth certificate not only places the child’s rights in jeopardy, but also endangers the rights of the parents to custody of their own child.

La-aw observed how “happy and relieved” Warisara’s parents became once she outlined for them how the law protects Warisara’s right to a birth certificate.

After IJM Thailand contacted the local government regarding Warisara’s case, the district office soon invited IJM and Warisara’s parents to come and reapply for the birth certificate.

Two IJM representatives accompanied Aasek to the district office to obtain a birth certificate for his daughter. IJM lawyer Rittirong Kornrittidej recalled the moment Aasek received the document, “When [the district official] called Warisara’s name, her father stood up as fast as he could and hurried to receive his daughter’s birth certificate. I had to do my best to keep up with him!”

Aasek had finally received justice for his family. “He left with happiness on his face,” Rittirong said.

Perpetrator Convictions in Manila

MANILA, THE PHILIPPINES – In January 2011 alone, Manila courts have already handed down three convictions in trafficking cases prosecuted by International Justice Mission. Each of these convictions came after years of patient collaborative effort by IJM lawyers and government prosecutors.

In the first case, a bar manager was convicted of Qualified Trafficking—the most serious category under Philippine anti-trafficking law—and sentenced to 20 years imprisonment and a fine of 1 million Philippine pesos (approx.. $23,041 USD). The perpetrator had been on the run since police conducted an operation to rescue trafficked women from the bar he managed in 2007. After extensive detective work by police and an IJM investigator, he was arrested in 2008. Over the next three years, IJM social workers spent many hours caring for the four young girls he and his cohorts had trafficked into prostitution. Along with IJM attorney Liwliwa Agbayani, the social workers encouraged and assured the four girls that it was both safe and right for them to testify against the men who had harmed them. Through their tears, the words of these four brave young women helped put a criminal behind bars.

In the second case, two pimps were selling three teenage girls for sex in plain view, on a popular Manila street where people shopped and walked to work—and just steps from a school where other girls the same age were able to pursue their education. In 2005, an IJM investigator and local law enforcement coordinated a rescue operation leading to the arrest of the suspects. After almost six years of IJM’s prosecution of the case in court, the perpetrators were both found guilty of Qualified Trafficking in Persons, and both were sentenced to life imprisonment and to pay a fine of 2 million Philippine Pesos (approx. $460,80 USD).

These three guilty verdicts send an important message that the Philippine government is protecting those who can't protect themselves.

Powerful Aggressor Sentenced to 3 Years for Sexual Abuse

GUATEMALA CITY – February 17, 2011: Following one of the most difficult cases in the history of IJM Guatemala, judges yesterday convicted a pharmacy owner on charges of child molestation and sentenced him to three years in prison.

This four-year-running legal battle has been a major challenge for IJM staff, presenting significant obstacles to the work of justice. Allegations arose of bribery, hiring false witnesses, and the fabrication of a traffic accident to serve as an alibi for the aggressor.

The aggressor comes from an influential family of lawyers. As the co-owner of a pharmacy, he was often called upon to prescribe medications. In 2007, the 15-year-old victim and her father went to the pharmacy to obtain a cream for her skin. The aggressor took her in the back and abused her, claiming his actions were necessary in order to apply the medication.

As the case finally went to trial this past month, the victim decided she could not testify; never having shared the story with her community, she did not want to talk about what had happened to her in front of the court.

Through the sheer dedication and sacrifice of the victim’s father and IJM’s support, the trial continued. A humble man from the highlands of Guatemala, the victim’s father endured 10-hour trips to Guatemala City in order to testify and support the prosecution. During his declaration he said, “This man abused my daughter, and she is of my own blood. It is as if he did it to me.” He spoke frankly and passionately, entreating the judges to hold the aggressor to account for his actions. The victim’s mother also testified, speaking through an interpreter in her local dialect saying, “I want justice for my daughter.”

Through the sacrificial commitment of a father fighting for his daughter and the perseverance of IJM’s legal team, justice has been done. The aggressor was sentenced to three years in prison, just one year shy of the maximum possible sentence.

In Guatemala, it is extremely rare for a case to achieve a conviction without the victim’s testimony. Nonetheless, the judges heard the evidence and the witnesses and were convinced of the pharmacist’s guilt, and they convicted him in spite of his having a team of private attorneys working on his behalf. “This is not just a conviction,” said IJM Attorney Rudy Fuentes. “This is a miracle!”
